Dr. Ulrich Sick will provide an overview on the situation of Alternative Dispute Resolution in Europe. The new EU Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on Certain Aspects of Mediation in Civil and Commercial Matters as well as the European Code of Conduct for Mediators will be major topics. Another focus will be on the different situation in Germany, Austria and Switzerland based on practical experiences of the lecturer. Finally Dr. Sick will share with the participants of the conference a contract clause, which he has developed, securing the settlement of a dispute stepwise by commercial negotiation, mediation and ultimately arbitration if needed, leaving the opportunity to seek preliminary legal protection by the ordinary courts in any jurisdiction in case of necessity.
