Welcome to the Oil, Gas & Petrochemical Network.

Group Mission/Vision: Provide its members with insights to new trends and emerging practices in the fields of contracting, commercial and relationship management in the oil and gas sector. This Network was started by the members of IACCM in the industry to talk about issues particular to them.

The Petrochemical, Oil and Gas Network is a global group of contracts and commercial practitioners from companies in the Petrochemical, Oil and Gas industries. The Network will create and share knowledge, within legal and ethical boundaries. The group will provide help to solve problems raised by its members related to the activites associated with commercial and contract management in the Petrochemical, Oil and Gas industries. This will be done by sharing ideas, discussing challenges, exploring new directions and, where appropriate, initiating research or inviting experts to present on key topics in the oil and gas sector related to contract, commercial and relationship management. Since this is a highly regulated industry, please be mindful of that when making postings.

The Network will:

  1. Build a vibrant network of contracts and commercial practitioners in the Petrochemical, Oil and Gas industries.
  2. Offer networking events whenever possible to our community.
  3. Provide standards and best practices for use by our community.
  4. Provide Ask the Expert Calls.
  5. Review available training and provide quality IACCM training in the Petrochemical, Oil and Gas industries
  6. Provide Subject Matter Experts and a “body of knowledge” for our community.
  7. Provide breakout forums at IACCM conferences for Petrochemical, Oil and Gas industry subjects.

Cloud Contracting

I am interested in perspectives on various issues and contracting approaches for the use of cloud services, particularly from niche providers who may, in-turn, actually have their applications hosted on a third-party provider like Microsoft, Amazon, Rackspace, etc. I'm looking for perspectives on the entire gambit of issues, including - protection measures used for data at-rest and in-transit; protection of video and images; right of return of all data upon request of customer; obligations of the supplier to delete data when no longer needed (either during the course of performing the services or upon termination of the services and return of the data to the customer); background checks on employees who may have access to the data; monitoring of access by all supplier personnel; business terms like fluctuations in the use of the service (bandwidth, storage space, processing capabilities); right to move the data to different locations in the same country; right to move data to a different country for processing and/or storage; obligations to notify in the case of suspected or actual breach/compromise of data.

Feed comeptition to EPC Award

Our Company is looking to pilot the use of a feed design then execute competition for an oil and gas project in the middle east. We will select 2/3 companies to execute a paid feed where at end they will provide their technical proposal and lump sum price to execute the project all the way to handover (turnkey) . The current approach is all capital projects are executed via EPC lump sum sourced against a company provided feed with all risk passed to the EPC contractor (in theory!). The proposition were testing is whether a a more market led approach rather than a prescriptive company led approach will generate more value. We have engaged our key suppliers in the CCG region and they are supportive of the concept which they claim has been very successful with other clients. I would be interested to hear from any members who have used this strategy before particularly 1) Competency/behaviors required of the client team 2) Tender and evaluation structure and principles thanks for any support you can provide

Confidentiality Agreements

Hey Guys, I would like to know that is best practice. Lets say I am sending out a tender and I am asking the bidders to supply sensitive information as part of the bid. Instead of each of them submitting a Confidentiality Agreement for my legal team to review. Can I send my company's confidentiality agreement to them. My aim is to reduce the legal workload from my legal team and place it on the supplier. What are your thoughts? DM
